Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Chatbot DZ website and application (the "Service") operated by Chatbot DZ ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Eligibility

The Service is intended for use by businesses and professionals. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into binding contracts.

2. Subscriptions and Payments

2.1. Pricing

The Service is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (monthly). The minimum subscription fee starts at 500 DZD per month.

2.2. No Free Trial

We do not offer a free trial period. Immediate payment is required to access the features of the Service.

2.3. Cancellation

You may cancel your Subscription renewal at any time through your account management page. Your cancellation will take effect immediately regarding future billing; however, you will retain access to the Service until the end of your current paid billing period.

3. Refunds Policy

We maintain a strict refund policy to ensure the quality of our service:

Eligibility for Refund: Refunds are ONLY granted in the event of a verified technical failure of the Chatbot DZ platform that prevents you from using the core features of the Service.
Timeframe: Refund requests must be submitted within 10 business days of the incident.
Exclusions: No refunds will be issued for "change of mind," lack of usage, or configuration errors made by the user.

4. Usage Limits and Acceptable Use

4.1. Usage Limits

Your Subscription is subject to usage limits (e.g., number of messages or conversations per month) depending on the plan you selected. Exceeding these limits may result in a pause of service or additional charges.

4.2. Prohibited Activities

You agree not to use the Service to:

Send unsolicited spam, marketing, or promotional materials without consent.
Engage in any illegal activities or promote illegal goods/services.
Harass, abuse, or harm another person or group.
Violate the policies of third-party platforms connected to the Service (e.g., TikTok, Meta).

Violation of this section will result in immediate termination of your account without refund.

5. Content and Liability

Important: Chatbot DZ is a tool ("Service") that allows you to configure automated responses. We do not control the content you create.

5.1. User Responsibility

You are solely responsible for the configuration of your chatbot and the content of the messages it sends. You agree that Chatbot DZ shall not be held liable for any errors, insults, misinformation, or inappropriate content generated by your chatbot due to your configuration or the AI inputs provided by you.

5.2. Indemnification

You agree to defend, indemnify, and hold harmless Chatbot DZ from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the Service or the content generated by your chatbot.

6. Intellectual Property

6.1. Our IP

The Service and its original content (excluding Content provided by users), features, and functionality (code, design, architecture) are and will remain the exclusive property of Chatbot DZ.

6.2. Your Data

You retain all rights to the data, product information, and conversation logs generated by your customers ("User Data"). We claim no ownership over the data you process using our Service.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Algeria, without regard to its conflict of law provisions.
